Limitation of Liability

BY USING THE SITE, YOU AGREE TO THE TERMS OF THIS SITE LISTED BELOW AND THAT THE COMPANY WILL NOT FOR ANY REASON OR CIRCUMSTANCE, AND REGARDLESS OF LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR ANY OTHER DAMAGES, HOWEVER CAUSED, AND REGARDLESS OF CHARACTER, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST SAVINGS, LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR OTHERWISE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY APPLIES, BY WAY OF EXAMPLE BUT WITHOUT LIMITATION, TO ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH (I) YOUR ACCESS TO, USE OF, OR INABILITY TO USE, THE SITE (INCLUDING ANY SERVICE OFFERED ON OR THROUGH THE SITE), OR (II) ANY ERRORS OR OMISSIONS IN THE CONTENT OF, OR PERFORMANCE OF THE SOFTWARE ON, THE SITE (INCLUDING ANY SERVICE OFFERED ON OR THROUGH THE SITE). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO SUCH EXCLUSIONS MAY NOT APPLY TO YOU. HOWEVER, SUCH EXCLUSIONS SHALL BE ENFORCEABLE TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Indemnification You agree to defend, indemnify and hold the Company harmless from and against any and all claims, losses, damages, liabilities, costs and expenses, (including, but not limited to, attorneys’ fees), arising from or related to your (i) use of the Site or (ii) violation of any of these

Terms.

At this time we would like to thank you for choosing Douglas Simons! However, there are some things you need to know. Below is an important list of terms that do concern you so please read carefully before any pressure washing or restaurant cleaning is performed on your property.

#1 Douglas Simons will not clean near any electrical lines, boxes and/or not completed electrical work. These areas will be passed over while the job is being performed unless we have told you otherwise.

#2 Douglas Simons is an exterior pressure washing company. Douglas Simons uses a high-output pressure washer that sprays water and mist onto your surfaces. Unless reported it is assumed that all surfaces on the exterior of your home or business are waterproof and watertight (the reason being is, this is the outside of your building and everything on the outside is subject to the elements, meaning any normal home should be waterproof and watertight.

Douglas Simons cannot be responsible for water damage to your building from pressure washing for instance: non-waterproof items on your home, leaky doors, leaky windows, leaky trim, leaky thresholds, Etc, all need to be reported to us before any pressure washing so we can take appropriate measures to ensure no damage is done from our pressure washing, or decide to not perform the work at all. If you feel you may have an air leak then you definitely will have a water leak and it is up to the owner of the property to take precautions so your property is not damaged or notify us so we can try and find a damage-free solution, or not perform the work.

#3 Douglas Simons will leave the work site clean which means we will not leave any mess from our work. Windows are rinsed not squeegeed and we always sweep up.

#4 All work is Due Upon Receipt (Net 7 days). We feel that even the larger companies can get this done without a problem. We are also fine with waiting longer for any monies due, but it comes with a price. Waiting longer than 7 days for our invoices to be paid does not allow us to continue to take every job we can. By saying no to certain jobs because we do not have the capital to pay for labor, chemical tools Etc. means we are losing money. The price on your estimate is a discounted price. The following is a list of what we expect if you are not paying within 7 days. 7-15 Days plus 10%, 15-30 days plus 15%, 30-45 days plus 20%, 45-60 days plus 25% over 60 days plus 35%.

#5 We do have a 100% satisfaction guarantee on our work. However, if you have talked us down on our price it becomes very hard for us to guarantee our work. If you are not paying our full estimated price we are not supplying the guarantee to you.

#6 Douglas Simons is a fully insured company if you would like additional information on this, please call.

All additional insured certs are made free of charge. Any additional insurance requirements needed beyond our existing insurance limits after the price of our original quote can be met with a price of the difference in cost needed to obtain the extra insurance.

#7 Final Waiver of liens can be provided for free, however notarized copies we add $150 plus any postage to the total invoice amount for our time.

#8 All work must be inspected by the owner or manager of the property within 3 hours of completion of our work to ensure no problems exist. We cannot be responsible for any calls after this. Water can damage certain items and these items need to be looked at immediately after the completion of our work.

#9 We will need water to do our work at your location. Unless otherwise noted.

#10 Douglas Simons only has so many days a year that are above freezing and can work. If you have commissioned him to come to a job to perform work and are not ready you will be liable for a trip charge of $150. and depending on the agreement you may be liable for the minimum service charge agreed upon which in most cases is $150 trip plus $195. per hour with a 3-hour minimum.

#11 Any cost to Douglas Simons to collect monies for work performed according to these terms will be charged to the customer.
